1. Description of Services

House of Moyra is a premium Indo-western women's fashion brand. Through our website, we provide users access to our curated collections, which may be purchased at the prices listed on the site. All products are subject to availability.

2. General

This Agreement sets forth the terms and conditions that apply to your use of our website (the "Site"). By accessing or using the Site, you agree to comply with all terms and conditions stated herein.

The right to use the Site is personal to you and is not transferable to any other person or entity. You are responsible for maintaining the confidentiality of your account credentials.

While we aim to keep the Site accessible at all times, we do not guarantee uninterrupted availability. The Site may be unavailable from time to time due to routine maintenance or circumstances beyond our control. We reserve the right to change, suspend, or discontinue any aspect of the Site at any time without prior notice.

We shall not be responsible for any data lost while transmitting information over the internet, as certain events affecting internet connectivity are beyond our control.

3. Membership Eligibility

Use of the Site is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Act, including minors (under 18 years of age) and un-discharged insolvents, are not eligible to use the Site independently.

If you are a minor, purchases on your behalf may be made by your legal guardian or parent, provided they are a registered user of the Site. We reserve the right to terminate your membership and refuse access if it is found that you are under 18 years of age.

4. Your Account

By using the Site, you represent that you are of legal age to form a binding contract and are not barred from receiving services under applicable Indian law. You agree to provide true, accurate, current, and complete information during registration and to keep it updated at all times.

If we have reasonable grounds to believe that any information provided is inaccurate, incomplete, or false, we reserve the right to suspend or terminate your account and refuse current or future access to the Site.

You are solely responsible for all activity that occurs under your account, including use by family members, friends, or any third party. We strongly recommend logging out at the end of each session. Please notify us immediately at hello@houseofmoyra.com if you become aware of any unauthorised use of your account.

Unauthorised access to restricted areas of the Site may be subject to prosecution under applicable law.

5. Your Information

"Your Information" refers to any information you provide to us during registration, through feedback, or via any communication feature on the Site. You are solely responsible for Your Information.

You shall not upload, post, transmit, or share any content that:

Belongs to another person without their consent;
Is harmful, harassing, defamatory, obscene, pornographic, or otherwise unlawful;
Harms or could harm minors;
Infringes any patent, trademark, copyright, or other proprietary right;
Violates any applicable law;
Impersonates another person or entity;
Contains software viruses or malicious code;
Threatens the sovereignty, integrity, or security of India or its relations with other nations.

By submitting Your Information, you grant House of Moyra a non-exclusive, worldwide, perpetual, royalty-free licence to use such information for the purposes described in this Agreement and our Privacy Policy.

6. Equipment

You are responsible for obtaining and maintaining the hardware, software, and internet connection required to access and use the Site. We shall not be liable for any damage to your equipment resulting from your use of the Site.

7. Electronic Communications

By using the Site or communicating with us via email, you consent to receiving communications from us through electronic records, including email, SMS, or notifications on the Site. Such communications shall constitute adequate notice where required under this Agreement.

8. Licence and Site Access

We grant you a limited, non-exclusive licence to access and use the Site for personal, non-commercial purposes. This licence does not permit:

Downloading or copying account information for the benefit of a third party;
Unauthorised hyperlinking or framing of any content from the Site;
Uploading or transmitting content that infringes third-party intellectual property rights;
Uploading malicious code or software;
Use of data mining, bots, or automated data extraction tools;
Any action that places an unreasonable load on our infrastructure.

Any unauthorised use will terminate this licence immediately.

9. Third-Party Links

The Site may contain links to third-party websites or resources. We have no control over such sites and are not responsible for their content, availability, or accuracy. We do not endorse any third-party site and shall not be liable for any loss or damage arising from your use of or reliance on any such external content or services.

10. Pricing

We strive to display accurate and current pricing on the Site. However, prices are subject to change without prior notice. Prices are not subject to comparison with identical or similar products available elsewhere.

In the event of a pricing or typographical error, we reserve the right to either contact you for revised instructions or cancel your order and notify you accordingly. If payment has already been processed at the time of cancellation, the full amount will be reversed to your original payment method.

All prices are exclusive of applicable GST. The applicable tax rate will be determined based on the shipping address. GST is not applicable on international orders.

11. Order Cancellation by House of Moyra

We reserve the right to cancel any order at our sole discretion, including but not limited to situations involving:

Quantity limitations or stock unavailability;
Errors in product or pricing information;
Quality concerns identified during our internal checks;
Failure to obtain required verification or information.

You will be notified in the event of a cancellation. If payment has been processed, the amount will be reversed to your original payment method.

12. Order Cancellation by the Customer

Cancellation requests must be submitted within 48 hours of placing the order. Orders that have already been processed or dispatched cannot be cancelled. We reserve the right to determine whether an order has been processed, and our decision in this regard shall be final.

13. Customisation

House of Moyra offers limited customisation on select products, subject to the following conditions:

The basic silhouette of a garment cannot be altered.
Accepted customisations include sleeve additions, coverage modifications, measurements, and colour changes, subject to availability.
Additional embroidery or embellishments are available on a chargeable basis.
All customised and made-to-order products are strictly non-refundable and non-exchangeable.
Customisation that involves size alteration is treated as a made-to-order item and is not eligible for return or exchange under any circumstances.
Minor fitting variations may occur depending on individual body types. Customers are advised to arrange any needed alterations locally. For assistance, contact hello@houseofmoyra.com.
House of Moyra reserves the right to withdraw or modify the customisation offer at any time without prior notice.

14. Delivery

We endeavour to dispatch orders within the timeframes mentioned on the respective product pages. Delivery timelines are estimates and may vary based on shipping location, supplier timelines, courier partner delays, or other unforeseen circumstances including weather disruptions, logistical issues, or force majeure events.

Each purchase is insured while in transit until delivered to your specified address.
A signature is required upon delivery, at which point responsibility for the goods transfers to you.
If you designate a third-party recipient (for example, for a gift), a signature at the delivery address constitutes evidence of delivery.
Delivery will be attempted a maximum of three times. If delivery cannot be completed after three attempts, the order may be cancelled.
If you are unavailable on a particular date, please notify us in advance at hello@houseofmoyra.com to arrange a suitable delivery window.
We are not liable for delays caused by third-party logistics partners or regulatory clearances.
In cases where we are unable to fulfil a confirmed order due to stock unavailability, product quality issues, or pricing errors, you will be notified and any payment made will be fully reversed to your original payment method.

15. Fraudulent Transactions

We monitor accounts and transactions to detect and prevent fraud. Users found operating multiple accounts or engaging in fraudulent activity will be liable for legal action under applicable law. We reserve the right to recover the cost of goods, collection charges, and legal fees from such persons.

In the event of a fraudulent or declined transaction, we reserve the right to immediately deactivate the account and cancel all pending orders without any liability. No refunds will be issued in such cases.

We shall not be liable for any loss arising from the decline of a transaction due to the cardholder exceeding agreed credit limits.

16. Payment and Credit Card Security

By providing your payment details on the Site, you confirm that you are the lawful owner of the payment instrument used and that all details provided are accurate. Payment information will not be shared with any third party except as required for fraud verification or under applicable law or court order.

We shall not be liable for any credit card fraud. Liability for fraudulent use of a payment instrument rests entirely with you.

17. Disclaimer of Warranty

All products and content on the Site are provided on an "as is" basis without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or accuracy. Any manufacturer warranties, if applicable, are provided by the respective manufacturer or supplier and not by House of Moyra.

We do not endorse or take responsibility for the accuracy of any third-party opinions, advice, or content available through linked sites.

18. Intellectual Property

All trademarks, logos, service marks, and content on the Site, including text, photographs, graphics, and software, are the exclusive property of House of Moyra and are protected under applicable intellectual property laws. You are prohibited from using, reproducing, modifying, distributing, or creating derivative works from any content on the Site without our prior written permission.

Downloading or saving content from the Site is permitted for personal, non-commercial use only.

19. General Legal Provisions

Nothing in this Agreement shall constitute a partnership, joint venture, or agency between you and House of Moyra.

If any clause of this Agreement is found to be invalid or unenforceable, the remaining clauses shall continue in full force and effect.
This Agreement constitutes the entire understanding between you and House of Moyra with respect to your use of the Site.
House of Moyra may transfer its rights and obligations under this Agreement without your prior consent.
Our failure to act upon a breach of this Agreement shall not constitute a waiver of our right to act upon any subsequent breach.
House of Moyra may terminate this Agreement or suspend your account at any time, at its sole discretion, for any conduct it considers unacceptable or in breach of this Agreement.

20. Arbitration

Any dispute arising between you and House of Moyra in connection with the validity, interpretation, implementation, or alleged breach of this Agreement shall be referred to a sole Arbitrator appointed by House of Moyra, who shall be an independent and neutral third party. The place of arbitration shall be Kolkata. Proceedings shall be governed by the Arbitration and Conciliation Act, 1996, and shall be conducted in English or Hindi.

21. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. Exclusive jurisdiction for any disputes not resolved through arbitration is conferred upon the courts at Kolkata.
